Lim Kian Leong & Co.

Lim Kian Leong &Co. was founded in 1985 by Lim Kian Leong, who had previously practiced in a major Kuala Lumpur legal firm. Today, the firm has expanded into a team of highly qualified lawyers (including four partners), all supported by a professional secretarial and paralegal team. Due to the company's intimate setting, Lim Kian Leong & Co. is in the unique position of being able to provide clients with exceptionally astute solutions to their legal problems.

Unlike many other legal firms in order to achieve the standards to which we aspire, we have taken the bold step to reduce our areas of practice so that we can develop a high level of service in the most difficult and challenging areas. We are thus now highly focused on Dispute Resolution and Corporate Advisory work, areas which often go hand in hand.

Lim Kian Leong & Co. has been engaged in several high profile commercial and corporate litigation matters leading to the implementation of some of the most complex litigation and settlement procedures ever seen in Malaysia.

A search on the Lexis Nexis and CLJ case reports show that over 100 legal suits involving Lim Kian Leong & Co. have been reported in those Law Reports.

Our Senior Partner has over 30 years’ experience and each of our other partners has over 20 years’ experience. They each practice in teams supported by Associates with varied experience including from the Attorney General’s chambers and academia.

As a result of the vast experience of our partners we are uniquely placed to advise on the most complex and contentious matters and to strategize the most efficient cost effective solutions for our clients. In fact, even if filing court proceedings is required, a large proportion of matters under our care result in amicable settlements being achieved at an early stage either through mediation or direct negotiations rather than long drawn out litigation, thus saving valuable time for our clients as well as costs.

Our firm filed one the very first if not the first application for Leave to file a Statutory Derivative Action to go to court under S181A of the Companies Act 1965, and has been involved in many cases of disputes between shareholders and directors.

We also acted for His Royal Highness the Sultan of Selangor in the first case to be referred to the Special Court, which was amicably resolved before going to trial.

We have acted in several high profile “mega” disputes involving very large and complex matters where the expertise and experience of our Partners in handling Billion Ringgit disputes under intense pressure and public scrutiny is of advantage to our clients. Many of these disputes were eventually amicably resolved.

Recently we successfully completed the resolution of all disputes between Tan Sri Dato’ Tajudin Ramli and the Government of Malaysia and Malaysian Airline Systems after disputes lasting several years.

We also acted for the majority shareholders in the Tan Chong Family dispute, which was successfully resolved.

Our firm also acted for Hong Leong Bank in the successful take over of EON Bank.

We also advised on and acted in the convoluted disputes between the shareholders of the BHH Southern Group, which resulted in the amicable resolution between the parties.

We have also acted in several large engineering and construction disputes involving Owners, Developers, Contractors, Engineers and Architects including acting for the Ret Ser Engineering Agency then a Taiwan Government owned engineering and construction company in their dispute against TNB involving the Sungai Piah Hydro Electric Power Station, in the dispute with the owner over the Kerpan Aquaculture Project which was arbitrated at the KLRCA, and their disputes with the PKNP over an industrial park development in Perak. All theses matters were successfully resolved.

We have acted for the owner of the Palm Grove Resort in its dispute with their Architect in an Arbitration under the PIAM Rules, and for Percon Construction (a member of the PNB Group) in disputes against its Engineers involving the Middle Ring Road project some of which were referred to Arbitration under the Board of Engineers Rules. We currently act for owners, architects, contractors, engineers, suppliers and sub contractors in a variety of matters.

Our Corporate Advisory work has included advising on the Public Listing of several companies including Muhibbah Engineering Bhd, Ralco Bhd, Ganad Bhd, Woventex Bhd, Palette Bhd, the Restructure of Insas Bhd which included a Debt/Equity and Asset injection exercise, numerous joint ventures and other agreements.
